This order confirmation signifies that a sales contract has been created. We reserve the right to withdraw from the sales contract in exceptional cases (e.g. if the goods are not available). In such instances, we will notify you thereof immediately and propose alternatives if appropriate. We will save your order data and send it to you by email together with our order confirmation. 5) Warranty | Repairs

New goods are covered by a statutory warranty obligation in all EU countries. Should any of the products purchased from be damaged in such a way that they are not covered by the warranty, it will in many cases be possible for us to remedy the defect. Please contact us in advance in cases covered by warranty (T +43 (0) 5572 58143-21 or We will also gladly issue a quotation if required.

The liability of Lenz Ges.m.b.H. is ruled out in the legally permissible scope for all material damage and financial losses. Lenz Ges.m.b.H. assumes no liability for consequential damage, third-party damage or lost profit.

6) Invoice | Receipt

We will send you an invoice by mail merchandise containing all information relevant to your order (order number, buyer’s anagraphic data, list of articles ordered including the quantity and value, order sum, information on delivery and payment, etc.). Please keep this invoice! It is important as evidence of your purchase if you need to make a complaint, and also for your insurance company in the event of theft. We save your orders. Should you lose the documents pertaining to your order, please contact us by email/fax/phone. We will gladly send you a copy of your order data.

Provided nothing different was agreed, the invoice is due for payment within 14 days as of the invoice date, without deduction. The punctuality of the payment shall be determined by the entry of the entire invoice amount in our account. Transaction costs and fees shall be borne by you.

Once the entire invoice amount has been received, Lenz Ges.m.b.H. will send the ordered good without delay, but after 30 days at the latest. Partial deliveries are permitted.

If the delivery is delayed, for instance due to force majeure or other obstacles, regardless of whether these arise at our premises, at your premises or at the premises of a third party, the agreed delivery deadline shall be extended accordingly and you must set us an appropriate time extension in writing. Such obstacles include, for example, war, civil commotion, significant operational disturbances, accidents, labour conflicts, delayed or defective deliveries, official measures or neglect and natural events.

You are not permitted to offset counterclaims of any type whatsoever against the claims from us. You have no right of retention.

7) Jurisdiction and applicable law

Exclusively Austrian substantive law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods, is to be applied.

The court with jurisdiction ratione materiae at the customer’s domicile is agreed as the place of jurisdiction, whereby the customer’s domicile at the time of the conclusion of the contract is authoritative. Lenz Ges.m.b.H. also has the right to file a suit against the customer at the latter’s place of general jurisdiction.

We expressly emphasise that we have no influence whatsoever on the design and content of the linked web pages and herewith expressly dissociate ourselves from all content on linked web pages. Amongst others, Lenz Ges.m.b.H. distributes articles intended for use in hazardous sports (e.g. mountain sports, ski touring, etc.). 10) Retention of title

Lenz Ges.m.b.H. reserves the right to retain title to the delivered items until it has received all the payments from the contract and the associated receivables. The customer undertakes neither to pledge nor to sell the delivered items until this time. In the event of seizure of the delivered items, the customer must refer to the right of ownership of Lenz Ges.m.b.H. and must inform the latter without delay.
